Terms of Use

1. Acceptance of Terms
By accessing or using the Homefree web platform at https://www.homefree.co.nz or the Homefree mobile application (collectively, the “Service”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, do not use the Service.
Homefree reserves the right to modify these Terms at any time. We will notify you of material changes via email or in-app notification. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.
2. Description of Service
Homefree is a mortgage management and tracking platform that connects licensed mortgage advisors with their clients (households). The Service provides tools for tracking loans, properties, property valuations, loan payments, and loan balances.
Homefree is a data management and information platform. It is NOT a financial advisory service. The platform facilitates the relationship between licensed mortgage advisors and their clients but does not itself provide financial advice.
3. Account Types and Eligibility
The Service offers three account types:
- Admin — Platform administrators with operational access.
- Advisor — Licensed mortgage advisors who manage client households.
- Client — Individuals tracking their homeownership journey with their advisor.
You must be at least 18 years of age to create an account. Accounts are personal and non-transferable. You must provide accurate and complete information during registration and keep it up to date.
4. Advisor Authority
Clients may grant their assigned advisor authority to act on their behalf within the platform. This authority allows advisors to manage financial data, properties, and loans within the client's household.
- Authority is granted through an explicit consent mechanism within the platform, and the date of consent is recorded.
- Clients may revoke this authority at any time through their account settings.
- This authority applies only within the Homefree platform and does NOT constitute a power of attorney or any legal authority outside of the Service.
5. Financial Disclaimers
Please read this section carefully.
- Homefree does NOT provide financial advice. All information displayed is for informational purposes only.
- Mortgage calculations provided by the platform are estimates and should not be relied upon for financial decisions.
- Rate cards and interest rate information displayed are informational and may not reflect current market rates. Always confirm rates with your lender directly.
- Property valuations entered in the platform are user- or advisor-provided estimates unless otherwise indicated, and do not constitute professional valuations.
- Loan balances displayed may not reflect real-time figures. Users should verify balances with their lender.
- You should seek independent financial advice from a qualified professional before making any financial decisions.
- Homefree is not responsible for any decisions made based on data displayed in the platform.
6. User Responsibilities
Advisors must:
- Maintain appropriate licensing and registration under New Zealand financial services regulation, including the Financial Markets Conduct Act 2013.
- Keep client data accurate, current, and confidential.
- Take responsibility for the accuracy of loan, property, and financial data they enter on behalf of clients.
- Comply with all applicable disclosure requirements under the Financial Services Legislation Amendment Act (FSLAA).
- Not use the platform to provide advice they are not qualified to give.
Clients must:
- Provide accurate personal and financial information.
- Notify their advisor of any changes to their financial circumstances.
- Review data entered on their behalf for accuracy and report any errors.
- Keep their account credentials secure.
7. Intellectual Property
The Homefree platform, including its design, code, and content, is owned by Homefree and protected by applicable intellectual property laws. Lender logos displayed on the platform are the property of their respective owners and are used for identification purposes only.
Data you enter into the platform remains your property. By using the Service, you grant Homefree a limited licence to store, process, and display your data as necessary to operate the Service.
8. Prohibited Uses
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms.
- Scrape, crawl, or use automated means to access the Service.
- Share your account credentials with any other person.
- Upload malicious content, viruses, or harmful code to the platform.
- Impersonate another person or entity.
- Attempt to circumvent any security measures, including authentication or access controls.
- Interfere with or disrupt the integrity of the Service or its infrastructure.
9. Third-Party Services
The Service integrates with third-party providers to deliver its functionality, including cloud database and authentication services, error monitoring and performance tools, analytics services, mapping and geocoding services, email delivery services, and hosting providers. Your use of the Service is also subject to the terms and privacy policies of these third-party providers. Homefree is not responsible for the actions, practices, or availability of any third-party service.

10. Limitation of Liability
To the maximum extent permitted by New Zealand law, Homefree and its officers, directors, and employees shall not be liable for:
- Any inaccurate financial calculations or estimates provided by the platform.
- Any financial decisions made based on data displayed in the Service.
- Actions, advice, or conduct of advisors using the platform.
- Interruptions or outages of the Service or its third-party providers.
- Loss of data, except where caused by our gross negligence.
- Any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service.
The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied.
11. Indemnification
You agree to indemnify and hold harmless Homefree from any claims, damages, losses, or expenses (including legal fees) arising from your breach of these Terms, your use of the Service, inaccurate data you provide, or your violation of any applicable law or regulation.
12. Dispute Resolution
These Terms are governed by the laws of New Zealand. Any dispute arising from these Terms or your use of the Service shall be resolved as follows:
- Negotiation — The parties will first attempt to resolve the dispute through good faith negotiation.
- Mediation — If negotiation is unsuccessful, the dispute will be referred to mediation under the rules of a New Zealand mediation service.
- Courts — If mediation is unsuccessful, the dispute will be submitted to the exclusive jurisdiction of the courts of New Zealand.
13. Termination
You may close your account at any time. Homefree may suspend or terminate your account if you breach these Terms or engage in prohibited conduct. Upon termination, your right to use the Service ceases immediately. Data handling upon termination is described in our Privacy Policy.
14. Mobile Application
If you access the Service through the Homefree mobile application, the following additional terms apply:
- Your use is also subject to the terms of the Apple App Store or Google Play Store, as applicable.
- The app may receive over-the-air updates to deliver improvements and fixes. By using the app, you consent to receiving these updates.
- Homefree is solely responsible for the app and its content. Apple and Google have no obligation to provide maintenance or support for the app.
